The annual EB-5 visa allocation is divided into four categories:
- 20% reserved for rural projects
- 10% reserved for high-unemployment projects
- 2% reserved for infrastructure projects
- 68% unreserved
Updated August 2026: The August 2026 Visa Bulletin lists the rural, high-unemployment, and infrastructure EB-5 set-aside categories as “Current” for India, China, and other listed countries. India's unreserved EB-5 category remains unavailable for final action. Visa availability changes month to month and is not guaranteed to remain Current.
View the U.S. Department of State Visa Bulletin → We intentionally avoid saying “no backlog” or “visa immediately available” as a blanket claim. The accurate statement is: the August 2026 Visa Bulletin lists the rural, high-unemployment, and infrastructure set-aside categories as Current. Visa availability can change in future bulletins, and a category that is Current today is not guaranteed to remain Current.
