Source and Path of Funds

What Indian investors in particular need to prepare — and how it's different from documenting the money's journey.

Every EB-5 petition must document that the investment capital was obtained lawfully, and how it moved to the investment account. These are two distinct concepts:

  • Source of funds: how the investor legally earned or received the money.
  • Path of funds: how the money moved from its original source, through any intermediate accounts, to the EB-5 investment account.

Common Lawful Sources

  • Salary and accumulated savings
  • Business income
  • Sale of real estate
  • Sale of shares or business interests
  • Gift from parents or relatives
  • Inheritance
  • Loan secured by the investor's assets
  • Investment or rental income
