Removal of Conditions on Permanent Residence

Filed near the end of the two-year conditional residence period to convert conditional status to full permanent residence.

Form I-829 is filed during the 90-day window immediately before an investor's two-year conditional permanent resident status expires.

The petition must demonstrate that the required investment was sustained and that the required job creation occurred (or is expected to occur within a reasonable time), consistent with the project's business plan and economic report.

USCIS approval of Form I-829 removes the conditions on the investor's permanent residence. Approval is not automatic and depends on the project's actual performance against its job-creation and investment-sustainment requirements.
