Form I-485

Adjustment of Status

Filed by investors already lawfully present in the United States to adjust to conditional permanent resident status without leaving the country.

Typically filed by: Investor (optional)

Form I-485 is available to investors who are lawfully present in the United States when a visa is immediately available in their category and all other eligibility conditions are met.

Where eligible, Form I-485 may sometimes be filed concurrently with Form I-526E — this is known as concurrent filing.

Concurrent filing is not available to every applicant; eligibility depends on visa availability at the time of filing and the investor's current immigration status.

This is a general explainer, not legal advice, and does not describe the requirements of any specific case. Confirm current form editions, fees, and instructions directly at uscis.gov (or travel.state.gov for DS-260) before filing.
